Terms of Service

Definitions

"We", "Us", or "Our" refers to Almaz Pay, the entity that provides the Almaz Pay service.

"The Service" refers to Almaz Pay, a virtual crypto card service accessible via the Telegram bot (@AlmazPayBot) and the website (almazpay.com).

"You", "User", or "Your" refers to anyone who accesses or uses the Service.

"Card" refers to virtual payment cards issued through the Service.

"Supported Cryptocurrencies" refers to USDT (TRC-20, ERC-20), USDC, BTC, ETH, TON, and other cryptocurrencies as listed in the Service.

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

Section 1 — Access and Use of the Service

1.1 Account Creation

Access to the Service requires registration via our Telegram bot (@AlmazPayBot) or our website (almazpay.com). Upon registration, you receive a unique account that is tied to your Telegram account or login credentials.

1.2 Card Issuance

Virtual cards are issued instantly upon request. Cards operate on the Visa payment network. Each card is denominated in a fiat currency of your choice (USD or EUR).

1.3 Top-Up

Cards are funded by sending Supported Cryptocurrencies to the wallet address provided within the Service. A 4.5% commission is deducted from each top-up. The remaining balance is credited to your card in the selected fiat currency (USD or EUR) at the prevailing market exchange rate at the time of top-up confirmation.

1.4 Card Usage

Cards may be used for online payments, in-store payments (via Apple Pay or Google Pay), subscriptions, and transactions at any merchant that accepts the relevant card network. Physical cards may be offered in the future and will be subject to additional terms.

1.5 Exchange Rates

Crypto-to-fiat conversion is performed at the market rate at the time of top-up confirmation. We do not guarantee any specific exchange rate. Rates are determined by our liquidity providers and may differ from rates published on public exchanges.

1.6 No Identity Verification

The Service does not require identity verification (KYC) for standard use. However, we reserve the right to request information or suspend accounts in case of suspected fraud, abuse, or violation of these Terms.

Section 2 — User Obligations and Responsibilities

2.1 Lawful Use

You agree to use the Service only for lawful purposes. You shall not use the Service for money laundering, terrorist financing, fraud, or any activity that violates applicable laws in your jurisdiction.

2.2 Accuracy of Information

You are responsible for ensuring that any information you provide to the Service is accurate and complete.

2.3 Account Security

You are solely responsible for maintaining the security of your account credentials and Telegram account. We are not liable for unauthorized access to your account resulting from your failure to safeguard your credentials.

2.4 Prohibited Activities

You may not:

  • (a) Attempt to reverse-engineer, decompile, or hack the Service;
  • (b) Use the Service to process transactions for third parties without authorization;
  • (c) Engage in fraudulent chargebacks or disputes;
  • (d) Use automated tools, bots, or scripts to abuse the Service.

2.5 Indemnification

You agree to indemnify and hold harmless Almaz Pay, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

Section 3 — Cryptocurrency Transactions

3.1 Irreversibility

Cryptocurrency transactions are irreversible by nature. Once you send cryptocurrency to the provided wallet address, the transaction cannot be reversed, cancelled, or refunded.

3.2 Blockchain Confirmations

Card balance is credited after the required number of blockchain confirmations. Confirmation times vary by network and are not controlled by us.

3.3 Incorrect Transfers

If you send cryptocurrency to a wrong address, wrong network, or an unsupported token, we are not responsible for the loss of funds and cannot guarantee recovery.

3.4 Network Fees

Blockchain network fees (gas fees) are your responsibility and are separate from our 4.5% commission.

Section 4 — Pricing and Payment

4.1 Commission

A 4.5% commission is charged on each crypto top-up. This is all-inclusive — no additional fees are charged for transactions, foreign exchange, or declined payments.

4.2 Card Issuance Fee

Virtual card issuance is free of charge. Premium card tiers or physical cards may be subject to additional fees, which will be clearly listed in the Service before purchase.

4.3 No Refunds

Due to the irreversible nature of cryptocurrency transactions and the instant activation of card balances, all top-ups are final and non-refundable.

4.4 Fee Changes

We reserve the right to modify fees at any time. Changes will be announced via the Service at least 14 days before taking effect.

Section 5 — Availability and Service Limitations

5.1 Availability

We strive for continuous availability but do not guarantee uninterrupted or error-free access to the Service.

5.2 Maintenance

We may perform scheduled or emergency maintenance that temporarily affects the availability of the Service. Where possible, we will provide advance notice of scheduled maintenance.

5.3 Card Network Limitations

Card acceptance depends on the Visa network and individual merchants. We do not guarantee acceptance at all merchants or in all countries.

5.4 Third-Party Services

The Service relies on third-party infrastructure including blockchain networks, card networks, and payment processors. We are not responsible for outages or issues caused by third parties.

Section 6 — Intellectual Property

6.1 Ownership

Almaz Pay, its software, brand, logo, and all associated materials are the exclusive property of Almaz Pay. They may not be copied, distributed, modified, or used without our express written permission.

6.2 User Data

Data you provide through the Service remains your property. By using the Service, you grant us a limited, non-exclusive license to process this data solely for the purpose of providing and improving the Service.

6.3 Feedback

If you provide feedback, suggestions, or bug reports, you grant us an unrestricted, royalty-free license to use this information to improve the Service without any obligation to you.

Section 7 — Limitation of Liability

7.1 Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Liability Cap

Our total liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.

7.3 Exclusion of Consequential Damages

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunity, regardless of the cause of action or the theory of liability.

7.4 Cryptocurrency Risks

You acknowledge that cryptocurrency values are volatile and that conversion rates may fluctuate significantly. We are not liable for losses resulting from exchange rate movements between the time of your top-up and the time of card usage.

7.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control, including but not limited to: Internet outages, blockchain network congestion, payment network disruptions, government actions, sanctions, natural disasters, or cyberattacks.

Section 8 — Account Suspension and Termination

8.1 Termination by User

You may close your account at any time by contacting us through the Service. Any remaining card balance should be spent before account closure, as we do not offer balance withdrawals to cryptocurrency or bank accounts.

8.2 Termination by Us

We may suspend or terminate your account at any time if we reasonably believe you are violating these Terms, engaging in fraudulent activity, or if required by law or a third-party partner (e.g., card network provider).

8.3 Effect of Termination

Upon termination, your access to the Service and all associated cards will be deactivated. Any remaining balance may be forfeited if the account is terminated for cause (e.g., fraud or Terms violation).

8.4 Dormant Accounts

We may terminate accounts that have been inactive for twelve (12) consecutive months. Where possible, we will attempt to notify you before deactivation.

Section 9 — Privacy

9.1 Data Collection

We collect minimal data necessary to provide the Service, including your Telegram account information, transaction history, and card usage data.

9.2 No Sale of Data

We do not sell or rent your personal information to third parties.

9.3 Disclosure

We may disclose information to comply with legal requirements, prevent fraud, or as necessary to provide the Service through our partners and service providers.

Section 10 — Changes to Terms

10.1 Right to Modify

We may modify these Terms at any time at our sole discretion.

10.2 Notification

Material changes will be announced via the Service (Telegram bot notification and/or website update) at least fourteen (14) days before taking effect.

10.3 Acceptance

Continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service immediately.

Section 11 — Miscellaneous

11.1 Entire Agreement

These Terms constitute the entire agreement between you and Almaz Pay regarding the use of the Service and supersede all prior agreements, understandings, and communications.

11.2 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

11.3 Assignment

We may assign our rights and obligations under these Terms to a third party in connection with an acquisition, merger, or similar transaction. You may not assign your rights or obligations without our prior written consent.

11.4 No Waiver

Failure by us to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it at a later time.

11.5 Electronic Communications

You agree that communications conducted via Telegram, email, or through the Service constitute valid written communications for all purposes.
